Over the course of the last four decades, William Leon McBride has distinguished himself as one of the most esteemed and accomplished philosophers of his generation. This volume—which celebrates the occasion of his seventy-fifth birthday—includes contributions from colleagues, friends, and formers students and pays tribute to McBride’s considerable achievements as a teacher, mentor, and scholar.

Electrophysiology deals with apparatus applied in a stimulus response situation. This technique is partly concerned with physical problems, partly with biological ones. The failure to appreciate differences in these problems leads to assumptions which require critical examination. Assumptions stating the constancy of objective stimuli, the meaning of inter and intra-individual variation, and the stability of the so-called “resting level” are examined.Some experiments are cited which reveal complications by the apperception of the patient and which have a significant influence on electrophysiological (...) data. In diesen Untersuchungen werden Methoden angewandt, welche teils aus der biologischen, teils aus der physikalischen Wissenschaft stammen. Es kommt vor, dass Unterschiede in Messungsprobleme innerhalb jedem Fachgebiet nicht richtig gewertet werden, was zu Annahmen führt, welche eine kritische Analyse bedürfen.Annahmen was betrifft, die Konstanz von objective Reize, die Bedeutung von inter- und intra-individuellen Variationen und die Konstanz des sogenannten „resting level”, wurden einer Analyse unterzogen.Einige Experimenten sind zitiert, die eine erhebliche Komplexität in der Wahrnehmungsempfindung des Patienten nachweisen und die eine bedeutungsvolle Einfluss haben auf den elektro-physiologischen Angaben. Das Hervorrufen Spannungsreaktionen durch Routine-vorgänge im Laboratorium wurde diskutiert und eine Weise um mit möglicherweise zuverlassigem Erfolg elektro-physiologischen Messungen aus zu führen wurde vorgeschlagen. La pornographie serait-elle l’objet d’un malentendu? Alors qu’elle s’offre une santé particulièrement réjouissante au regard du commerce mondial, il semblerait que les jugements portés sur elle ne parviennent jamais à toucher leur but. C’est que la pornographie brouille cette aptitude à dessiner clairement les limites que l’on souhaiterait repérer entre réel et imaginaire. La condamnation de cette imagerie sous l’étiquette « obscène » révèle ainsi l’incapacité à juger de la place véritable des représentations de la sexualité dans notre société, mais (...) aussi et surtout, elle révèle la difficulté à identifier le réel lui-même, et signe un dialogue de sourds sur le sens que l’on pourrait donner aux choses représentées en général. C’est sans doute qu’il y a méprise sur l’objet même de la représentation. C’est aussi que l’analyse qui ressort de ce phénomène ne parvient que rarement à sortir d’un aveuglement subtilement construit par les appartenances culturelles et les intérêts idéologiques. Effaçant les frontières a priori certaines entre imaginaire et réel, l’image pornographique donnerait au jugement une portée incapable de s’ancrer dans l’un où l’autre monde. (shrink)

One dark and rainy night, Yuso sexually assaults and tortures Zelan. In escaping from the scene of his crime, he falls heavily and becomes an impotent paraplegic. Instead of treating his fate as divine retribution for his wicked acts, Yuso sees it as sheer bad luck. He shows no remorse for what he has done, and vainly hopes that he will recover his powers, which he now treats as involuntarily hoarded resources to be used on less rainy days. In the (...) presence of others, he pretends that he has turned over a new leaf. He asks for religious and educational books, hoping to make up for his poor education and deprived social background. But he immediately discards them when he is alone in favor of the pornographic magazines which he has bribed a nurse to smuggle in for him. His deception and various obscene acts committed in the hospital are exposed; by the time he comes up for trial, everyone knows that he is still a lustful, sadistic, and unrepentant man. Most retributivists have a sufficient justification for punishing Yuso independently of the social consequences of his punishment. Two features of the case might cause some difficulties. First, Yuso has already experienced considerable suffering and deprivation both before and after his crime, and retributivists might disagree about the relevance of the suffering to his punishment. Secondly, Yuso is unrepentant, and it is unlikely that punishment will change him. This might, as we shall see, create a problem for those who think that the justifying aim of punishment is the moral reform of the offender. (shrink)

What ecological advantages do animals gain by being able to detect, extract and exploit wavelength information? What are the advantages of representing that information as hue qualities? The benefits of adding chromatic to achromatic vision, marginal in object detection, become apparent in object recognition and receiving biological signals. It is argued that this improved performance is a direct consequence of the fact that many animals' visual systems reduce wavelength information to combinations of four basic hues. This engenders a simple categorical (...) scheme that permits a rich amount of sensory information to be rapidly and efficiently employed by cognitive machinery of limited capacity. (shrink)

Sher's notion of deserved punishment has unacceptable implications. It does not justify punishing some serious wrongdoers, who are unwilling to commit lesser wrongs, more severely than minor offenders. It requires victim-inflicted punishments which repeat the wrongdoings, with the roles reversed. But if Sher moves away from such victim-inflicted punishments, then his theory should treat wrongdoers like tort-feasors who have to pay monetary compensations to their victims.

Constitutionalism and the Rule of Law are related ideas about how the powers of government and of state officials are to be limited. The two ideas are sometimes equated. But constitutionalism, generally understood, usually refers to various constitutional devices and procedures, such as the separation of powers between the legislature, the executive and the judiciary, the independence of the judiciary, due process or fair hearings for those charged with criminal offences, and respect for individual rights, which are partly constitutive of (...) a liberal democratic system of government. The Rule of Law, on the other hand, embodies certain standards that define the characteristic virtues of a legal system as such. (shrink)

Recently a child’s right to a father was invoked to justify the prevention of single women from obtaining access to IVF. This article explores the conceptual and normative issues about the nature of the right and its conflict with a woman’s right to procreative autonomy. The discussion relates the conceptual issues to those raised in the context of ‘wrongful life’ tort cases. It concludes that the right to be born with a father, although conceptually sound, does not justify the restriction (...) on the procreative right of single women. (shrink)
